Terms & Conditions of service

(i) Registration

By registering your details with us you agree to abide by the rules, terms and conditions as laid out within these terms of service. This agreement constitutes a legal document between you and Net Acquisitions and the services provided by myholidayfriends.

Registrations will not be accepted from individuals who are below the age of 16 years.

(ii) Membership Structure

myholidayfriends currently offer two types of membership;

Free (Termed as ‘Platinum’ Members and available to all registered visitors) and Paid For (Termed as ‘Platinum Plus’ Members and available to individuals who pay an annual subscription fee).

‘Platinum Members’ have the facility to:

Put a message (Referred to as Write a Postcard) on the ‘Finding Old Holiday Friends’ message board. Write a Postcard on the ‘To make new holiday friends to meet up or go on holiday with’ message board. Write a Postcard in the ‘Sharing your holiday memories’ message board. Write a Postcard in the ‘Recommend a holiday or destination to myholidayfriends’ message board. Write a Postcard in the ‘Requesting information on a holiday or destination’ message board. Receive emailed messages sent by ‘Platinum Plus Members’. Receive email messages which offer discounts on travel products/services. Enter myholidayfriends competitions, prize draws or other promotional contests.

In addition to all the above ‘Platinum Plus Members have the facility to:

Send email messages to addresses of both ‘Platinum’ and ‘Platinum Plus’ Members. Place photographs (Referred to as ‘Post a Picture Postcard’) on any myholidayfriends message board. View the Postcards on any message boards on myholidayfriends Write a Postcard on any message boards on myholidayfriends. View the picture Postcards on any message boards on myholidayfriends Chat live via any chat room on myholidayfriends.

myholidayfriends will change the specific services offered to our members from time to time and has the right to do so without advance notice to our members.

Although we have no obligation to screen or edit information that is posted or shared by members, we reserve the right to remove any objectionable information, at our discretion, without notice.

You agree to:

Follow all national and international laws and regulations. Maintain the confidentiality of your password and login identity. Provide accurate and appropriate information about yourself. Please do not post sexually explicit language. You agree to keep any information that you post on the site within the convention of good taste. We do not review the directory or individuals’ profiles looking for inappropriate material, but if it is brought to our attention, we will require that you revise or delete the inappropriate information. We have the right to request edits or make edits to your personal information at our discretion.

You agree NOT to:

Use incognito names when registering or communicating on our site. Use your access to myholidayfriends for any commercial purpose. Send junk mail to our members or solicit our members for commercial purposes. Post your email address anywhere on the site including any messages you post. Post your phone number or address. Republish any information found in the site without first obtaining written permission from myholidayfriends. Post any false, misleading, slanderous, libelous, or inaccurate information about others on our site. In the event that you do, we have the right to release your identifying information to the police, our lawyers or the individual you mentioned in your posting so that they may take action against you. Post or forward any confidential correspondence from myholidayfriends. Post any material that is not entirely your own or for which you do not have full rights to use. Delete or otherwise revise any material posted by another person. Use any device, software, or routine to interfere (or attempt to interfere) with the proper working of myholidayfriends’ site or any activity being conducted on the site. Post insider information or corporate trade secrets. Post inaccurate information about yourself or others. Post any threats of bodily harm or any other illegal activities. Take any action that imposes an unreasonable or disproportionately large load on the site’s infrastructure (including without limitation, flooding, spamming, mail bombing or crashing the site.)

(iii) Personal Information & Submissions:

By submitting your personal and related information to us, you are granting to myholidayfriends a royalty-free, worldwide, nonterminable, exclusive license to use this information and your exact words and photo’s (and excerpts and edited versions of your submissions) in all media now known or hereinafter developed, and in promotions, and to sublicense and transfer this right to third parties, and you waive all claims against myholidayfriends for any violations of copyright, rights of privacy, publicity, and deformation or other personal tots arising from myholidayfriends’ use of the information of such media. No payments shall be due to you for such grants of rights, and you may or may not receive credit as the author of such works in any use of them.

(iv) Disclaimer of Warranties:
Except as specifically provide in this provision, the site and its content are provided ‘as is’ and myholidayfriends disclaims, and you waive, any warranties, express or implied, as to the merchantability, fitness for a particular use or purpose, title, non-infringement, or any other warranty, condition, guaranty, or representation related to the site and its content and those arising by statute or otherwise in law or from a course of dealing or usage of trade. The functions, materials and content of the site are not warranted to be uninterrupted or without error. And myholidayfriends and its providers do not warrant the accuracy, currency or reliability or information on the site. You assume the entire risk and cost of repairs or corrections to your hardware or software due to the use of the site.

(v) Customer Warranties & Indemnification:

You shall abide by all the terms and conditions of this agreement. You will not take any action which would derogate myholidayfriends’ or its licensors’ rights in and to their intellectual property or content. You will not infringe on the copyrights of any third parties. You will not violate any laws in your use or postings of information on the site and You will not interfere in the business of myholidayfriends by posting information that violates the rules outlined above or by attempting to divert traffic from the site. You shall indemnify and hold harmless, and at myholidayfriends request defend, myholidayfriends from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs and expenses arising out of any claim of any third party resulting from any breach of your representations, warranties or covenants set forth in this agreement. You shall reimburse each indemnified party on demand for any costs, expenses and liabilities incurred by such indemnified party to which this indemnity relates.

(vi) Links to Other Sites:

The site may contain links to other sites. myholidayfriends does not endorse any other site and is not liable for any loss or damages related to the content, products or services available through those sites. If you have any problems or concerns regarding other sites, please contact their site administrator or Web master directly.

(vii) Changes to this Agreement:

myholidayfriends reserves the right to change this agreement from time to time, and post any changes on the site. Should we change this agreement we will notify you on the site. The new agreement and terms will take effect and will govern our services and our relationship with you.

(viii) Legal Standing:

This agreement shall be governed by and construed in accordance with the laws of England and Wales.

This legal document sets out how myholidayfriends identifies you and how it handles your data, it should be read in conjunction with myholidayfriends Terms & Conditions of Service.

Should we for whatever reasons change our privacy policy you will be notified of the changes in the same manner as we notify any changes to our terms and conditions of service.

Email Addresses:

Myholiday friends will not make your email address available to any other person on any screen on the myholidayfriends site.

myholidayfriends may include within the site interactive advertising for other businesses or services. They may also use and provide to third parties, anonymised demographic data provided by myholidayfriends members to target this advertising in the most appropriate way.

Newsletters:

We may have regular or occasional newsletters which members will receive from time to time.

Changes in myholidayfriends Business:

If all of the assets of myholidayfriends operating business are acquired by a third party, we may transfer personal data we hold to that party.

Places of Processing:

Any personal information held by myholidayfriends is held and processed on computers in the UK.
